To me it seems logical to let them choose afterwards. The RoE's have been
around since before the last war, but the fluff says that cans were
routinely brought in to have their AIs overhauled because they'd burned
out (i.e. the can was becoming Emancipated). So the can could only "keep"
the Emancipated edge if he burned out his AI after the war, or under very
unusual circumstances.
