Is there a bounty on the bandit's heads? Anyone
offering a reward? If not, they get nothing. As for
the horses, equipment and any loot found ... they were
probably stolen, and go back to the original owners.
One of my gripes about D&D is how skewed legality and
morality. It's not legal to kill someone just based
solely on them being evil, and it's not legal to take
their stuff either. Doing so makes you just as evil.
If they attack you, self defense is allowable, but if
they aren't presently being threatening, you need a
whole bunch of non-circumstance proof to be able to
put some lead into them, or even get a sheriff to lock
them up. And just forget about laying claims on their
stuff ...
Other Marshals may have different mileage on this
viewpoint.
For this case though, have a bounty on the bandit's
head (assuming this isn't a first offense) and they
get the bounty. If I recall, they are supposed to
bring the bandits to where the bounty is offered to
collect, but it all depends on how lenient you want to
be.
