AW: [DL] DRC Article Submission Problems

Hi folks,

Calm down, I suppose we've got a mistake here.

1.Concerning the power lists:
...............................

I asked Shane in a mail from the 4'th december to use the stuff on the
peginc page.
------------------------------
>Hi Shane,
>
>here's Marcus Dury aka Tenning the Junker, webmaster of the Deadlands
Resource Center (DRC).
>
>A few month ago I wrote you a mail concerning the current development
state of the DRC.
>
>In the meantime we had a few problems and development stopped, but
since 2 weeks we're
>programming again and the layout of the DRC is almost finished.
>
>Never the less we need still more content to launch the page. So I ask
you to give us the
>permission to use some of the official content of the www.peginc.com
page.
>
>Please feel free to visit the current development state of the DRC @:
>
>I also invite you to register at our message board system @:
f;act=Reg;CODE=00
>
>So far so good.
>
>I hope that you like our page and that we'll keep contact.
>
>Marcus
------------------------------------------------------------------------
-
He answered me and told me that I could use everything puplished on the
www.peginc.com page as long as the appropriate copyright information is
attached.

------------------------------------------------------------------------
-
>HI Marcus,
>That'd be fine. Just make sure all the appropriate copyright info stays
attached.
>Best of luck!
>Shane

------------------------------------------------------------------------
---------
I remember that these power lists have been directly on the peginc page
and I bookmarked them:

Here: http://www.peginc.com/Downloads/Reference/powers_files/powers.htm

As you can see the Domain starts with www.peginc.com

And I can't see any other copyright informations on these pages.
Therefore I had to think that it's under the copyright of www.peginc.com
for which I have the permission to use everything.

This is where the misunderstanding has occured.

I copied and pasted all the lists in several DRC articles and put a
www.peginc.com link and a copyright information bellow every list (As
Shane told me I should do).

Once again: The DRC could not see that these lists do belong to a
different copyright holder than www.peginc.com. The DRC never had bad
intentions. We do not want to violate any copyrights of anyone as we do
not want ours to be violated.

This is how it happened. I'm sorry if the DRC violated any copyright of
a third party. The DRC will immediately cancel the articles till we get
the OK of the respected author to bring them back online.

2. The Fine Print
....................................

I read the Fine print again, and yes I've to admit that it's too strict.
I cpoied and pasted this text from a big roleplaying page. The I just
changed a few words. (Like the name of the page) You all may know that
I'm not a native speaker and therefore it's not that easy for me to
write a new "Fine Print" text. That's why I took the other one and
changed a few things.

I do hereby state, that everyone who submits content to the DRC has the
full rights over his work. That the author decides when the text should
be taken from the page.

[If you register as an editor you can delete your submitted articels
using your personal administration panel at any time!]

It's not the intention of the DRC to steel any rights from the author,
he shall keep full controle.

All that the DRC wants, is to avoid to be hold responsible for copyright
violations and we do also want to use the articles for advertisement in
a upcoming newsletter for all interested Deadlands Gamers and Marshalls

Not more not less.

Once again I can only tell you that the DRC is a non-profit page build
by a few Deadlands interested students from germany, who worked for
quite a long time in their sparetime on building this page.

I'm sorry. I should have read the fine print more carefully and I
thought that I would have madde myself clear in the 'Fine Print': The
rights do fully stay at the author, he can delete his articles at any
time if he's an editor; he can send me an email and tell me to remove
the specified article, if he's not registered as an editor and used the
submission form.

I'll immediately change the phrases in the 'Fine Print' that are
misunderstanding and make this clear.

Cu at the DRC

Marcus Dury aka Tenning the Junker

Again, this is Stephan

The "Fine Print-Disclaimer" seems to be a bit wrong. I think its some
standard text and not corrected properly to fit the intentions of the
DRC. Again I´ll tell Tenning this and I think it will be clarified as
soon as possible. Because if you post something on the DRC it WILL
always be YOUR property. Thats for sure. And it will be removed anytime
you like. Thats how it should be, as much as I know, if i said something
wrong, Tenning will correct me in a few hours. And please submit your
article!!

thanks,
Stephan

I like the DRC site as a whole, but I'm reluctant
to submit any articles to them because of the
following fine print. Because, if I'm giving them an
article (which I would be) I want to have the right to
ask them to remove the article in case it's to be
published. I'm not sure any publisher would buy an
article that people can download for free.
   Just my 2 cents.
                                 Horace Black

The Fine Print
Any copyrightable works, products, or other
information (collectively, the "Work Product")
developed in whole or in part by the Author and
submitted to the DRC as an Article intended for
Internet publication on the Deadlands Resource Center
web site shall, upon submission, become and remain the
joint property of the DRC and the Reviewer.
The DRC retains Limited Electronic Rights: the
unrestricted current and future use of the Work
Product for use on the DRC website and any DRC partner
websites (including foreign translation and
syndication websites) so long as the Reviewer is
identified as the original author of the Work Product.

Regardless of Rights granted to DRC, the Reviewer
shall retain copyright over the Work Product and is
free to resell or reuse the Work Product elsewhere in electronic, print
and other media so long as such terms do not remove the rights granted
in this submission form to DRC.
