Ah - by Virginia had left the USA, hence the people of the Western part of that state believed they had every right to decide their own destiny!
Virginia MAY have had a constitutional right to leave the USA, but once they had, the US constitutiuon clearly no longer applied there and its very questionable whether another Constitution can be pressed on US citizens forced, against their will to leave the US. To West virginians the CSA's constitution had no validity, and they didn't leave the State, the State left them!

Seceding from the Union may or may not be legal*, but dividing a
State without its consent is expressly forbidden by the U.S. Constitution.
*--Please, no one start this argument here. Don't even think about
it. It's an argument that you cannot resolve. Talk about religion,
politics, abortion, or gay rights first. Or better still, just don't go
there at all. Thank you.
