[DL] Touched attacks

Good Day All;

I have a question for you six shooters.  Lately the Marshal has taken to 
(IMO) screwing my character over with touch attacks that do not do damage, 
but drain vigor or the such.

I will roll badly on my dodge, (usually needing a target number of infinity 
:-) ) and not able to make it miss by fate as their is no damage to buy off.

Are we missing something in the rules, or is this a genuine player screw 
job?
